Registering a new prescribed accommodation premises

Owners of prescribed accommodation are required to register their premises with Council.

Who needs to register?

The following types of accommodation must register their premises with Council:

  • hotels/motels
  • hostels
  • student dormitories
  • holiday camps
  • residential accommodation
  • Bed & Breakfast (if 5 or more people will be accommodated)
  • rooming houses (if 4 or more rent-paying people will be accommodated)

Pre-application assessment

To ensure your new premises is designed correctly prior to construction, Council can assess the proposal and floor plan and provide you with advice to ensure your premises is designed correctly and will comply with the relevant Acts, Regulations or Guidelines.

Intention to register

If you choose to register without the pre-application assessment, please notify Council of your intention to register.

Please note, if you forego the pre-application assessment there is a risk that your premises may not be designed and constructed in accordance with the relevant Acts, Regulations or Guidelines, which could result in costly alterations being required prior to the registration being granted.

Failure to register prescribed accommodation

Under the Public Health and Wellbeing Act 2008 failure of the operator of a prescribed accommodation to register the premises with their municipal Council may result in a fine of 4 penalty units. Failure of a body corporate to register prescribed accommodation with a municipal council may result in a fine of 10 penalty units.

Ongoing requirements

Once registered the premises will be inspected annually to ensure the accommodation complies with the Public Health and Wellbeing (Prescribed Accommodation) Regulations 2020.
